Terms of service

Effective 1 July 2026. Eleven sections, in plain language, and the important one is second.

The agreement

These terms are between you and Tallyn Inc., a Delaware C corporation at 1201 Second Avenue, Suite 900, Seattle, WA 98101. By creating an account or using Tallyn you agree to them. If you are agreeing on behalf of a company, you confirm you are allowed to.

We have written these in plain language on purpose. Tallyn is a developer tool and the people using it deserve clear terms, not defined-term appendices.

Tallyn is not a compliance certification

Tallyn is software that audits websites for accessibility issues and explains them in plain language. Using Tallyn, receiving an audit report, or acting on our recommendations does not constitute a legal certification that your site complies with any law, regulation, or standard, including WCAG, ADA, Section 508, or EN 301 549.

Audit reports are produced by language models and can be wrong, particularly on judgment about your specific situation and context. You are responsible for your own decisions about accessibility and legal compliance. For anything with legal stakes, such as a government contract or active accessibility litigation, engage a qualified accessibility professional or legal counsel.

Your account

  • You need an account, and the information on it must be accurate.
  • You are responsible for what happens under your account, so keep the credentials to yourself.
  • One person per seat. The Team plan includes five seats and each is for one named person.
  • Tell us promptly if you think someone else is using your account.

Your content stays yours

The page URLs and HTML you submit, and the audit reports produced from them, are yours. You grant us only the licence needed to run the service: to process the content, send it to a model provider to produce your audit report, and store the result for you.

We do not use your submitted content to train models, we do not sell it, and we do not share it with anyone other than the model provider producing your audit. You can delete any audit, or the whole account, at any time.

What you may not do

  • Use Tallyn to audit websites you do not own or do not have explicit permission to audit.
  • Resell or white-label the output as your own audit service without a written agreement with us.
  • Attempt to extract the prompts or scrape the service in bulk.
  • Send malware, deliberately malformed content, or content designed to break the service for other people.

Plans, payment and cancelling

  • The free plan includes one page audit per calendar month, counted in UTC and reset on the first.
  • Team is $29 a month and Business is $99 a month, in US dollars. Annual billing is ten months for twelve, charged once.
  • Subscriptions renew automatically until you cancel. We will not hide the cancel button, and we will not require a phone call.
  • Cancelling takes effect at the end of the period you have already paid for, and you keep read access to audits you have already run.
  • If we raise prices, existing subscribers keep their price for at least 12 months and get 30 days notice.
  • Refunds: if something we did stopped Tallyn working for you, email us and we will refund the period. We would rather give the money back than argue.

Availability

We aim for Tallyn to be available and we publish incidents on the status page. We do not offer a contractual uptime guarantee at this stage of the company, and we would rather say so than promise one we have not built the redundancy to keep.

Liability

To the extent the law allows, our total liability for any claim relating to Tallyn is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect or consequential loss, including lost profits or the outcome of any accessibility complaint or litigation.

Nothing here limits liability for fraud, or for anything else that cannot be limited by law.

Ending it

You can stop using Tallyn and delete your account at any time from Settings. We may suspend or close an account that breaks these terms, and where we reasonably can we will tell you why first and give you a chance to export your audits.

Governing law

These terms are governed by the laws of the State of Delaware. Any dispute will be heard in the state or federal courts located in King County, Washington, and both parties consent to personal jurisdiction there. Both of us waive a jury trial. We have not put an arbitration clause in, because we would rather not rely on one.

Changes

If we change these terms materially we will email account holders at least 30 days before the change takes effect. Carrying on using Tallyn after that means you accept the new version. This version is effective 1 July 2026.
